1. Platform Overview
My Notary (hereinafter "the Platform") is an online service accessible via mynotary.io, operated by My Notary Ltd, a company registered in England and Wales (hereinafter "My Notary", "we", "our", "us").
The Platform connects clients with notaries commissioned by the competent authorities in the United States, duly authorised to perform notarial acts within their respective jurisdictions, for the remote online notarisation of documents intended for international use.
My Notary acts exclusively as a technological intermediary. Notarial acts are performed by independent notaries, partners of the Platform, under their own professional responsibility.
2. Definitions
- Client: any natural or legal person using the Platform to have documents notarised.
- Notary: a certified public notary commissioned by the competent authorities of their respective state in the United States, acting as an independent contractor and partner of the Platform.
- RON (Remote Online Notarisation): a remote notarisation procedure conducted via secure video conference.
- Apostille: an official certification issued in accordance with the Hague Convention of 5 October 1961, attesting to the authenticity of a public document for use abroad.
- File: the set of documents, information and data relating to a notarisation request submitted by a Client.
- Services: all services offered by the Platform, including connection with a notary, the RON session, electronic signature and delivery of the notarised document.
3. Acceptance of Terms
Use of the Platform implies full and unreserved acceptance of these Terms and Conditions of Use (T&C). By creating an account or submitting a file, you acknowledge that you have read, understood and accepted these T&C.
If you do not accept these terms, you must not use the Platform.
4. Registration and User Account
4.1 Account Creation
Use of the Services requires the creation of an account. You agree to provide accurate, complete and up-to-date information, including:
- First and last name
- Valid email address
- Phone number
- Country of residence
- Any other information required for the provision of Services
Access to the Platform is secured through a magic link system sent to your email address. No password is required.
4.2 Account Responsibility
You are responsible for the security of your email address and all activities carried out from your account. You must notify us immediately of any unauthorised use of your account at support@mynotary.io.
4.3 Identity Verification
In accordance with the legal requirements applicable to notarisation, you must present a valid identity document during your notarisation session. Accepted identity documents include:
- Valid passport
- Valid national identity card
- Driver's licence (depending on the type of notarisation)
A second identity document may be required depending on the destination country of the document or the specific requirements of the service requested. Identity verification is carried out prior to the session by our accredited identity verification provider, whose decision is sovereign and cannot be challenged with My Notary. Verification is then visually confirmed by the notary in real time.
5. Description of Services
5.1 Services Offered
The Platform offers the following services:
- Connection with a notary commissioned in the United States
- Remote document notarisation via secure video conference (RON)
- Obtaining apostilles for notarised documents
- Delivery of notarised documents electronically and/or by post
5.2 Notarisation Process
The process includes the following steps:
- Submission of your file via the Platform (personal information, required service, documents, delivery method, signatory information)
- Secure online payment
- Prior identity verification via our KYC provider
- Notarisation session via video conference with the notary
- Electronic signature of documents in the presence of the notary
- Application of the notarial seal and finalisation of the document
- Delivery of the notarised document according to the chosen method
5.3 Service Limitations
The Platform does not provide:
- Legal advice
- Interpretation of the content of your documents
- Any guarantee of acceptance of your documents by destination authorities
5.4 Regulatory Updates
Laws and regulations governing notarisation may evolve and require My Notary to adapt its process at any time. Such adjustments do not affect the validity of services already provided and do not constitute grounds for cancellation or refund of a service already paid for.
6. Client Obligations
You agree to:
- Submit legal and authentic documents
- Not use the Platform for fraudulent or illegal purposes
- Be present and available during your notarisation session
- Have a stable internet connection and functional audiovisual equipment (camera, microphone, compatible browser)
- Present a valid identity document during the session, as well as a second document if required
- Follow the notary's instructions during the session
- Not record the video conference session without express authorisation
- Maintain respectful and appropriate conduct throughout the session
In the event of a breach of any of these obligations during the session, the notary reserves the right to immediately terminate the notarisation session. In such case, the service will be considered as engaged and no refund or credit will be granted. This decision falls under the exclusive discretion of the notary and cannot be challenged with My Notary.
7. Role and Responsibilities of the Notary
7.1 Notary Status
Partner notaries are independent professionals, duly commissioned by the competent authorities of their respective states in the United States. They are not employees of My Notary but act as independent contractors, under their own professional responsibility and in compliance with the laws and regulations of their jurisdiction of practice.
7.2 Notary Responsibilities
Partner notaries are solely responsible for:
- Verifying your identity during the session
- Compliance of the notarial act with applicable laws
- Authenticity of the notarisation act
- Adherence to applicable professional standards in their jurisdiction
7.3 Limitation of My Notary's Liability
My Notary acts exclusively as a technological intermediary. My Notary shall not be held liable for:
- Errors or omissions by notaries
- The content of notarised documents
- Acceptance or rejection of your documents by destination authorities
- Legal consequences related to the content of your documents
- Decisions made sovereignly by our identity verification provider
8. Pricing and Payment
8.1 Pricing
Service rates are indicated on the Platform. Prices are displayed in multiple currencies for information purposes only. The reference currency is pound sterling (GBP, £), which constitutes the official billing currency. Amounts displayed in other currencies are calculated based on current exchange rates and may vary. My Notary shall not be held liable for discrepancies arising from exchange rate fluctuations or fees applied by your bank.
The displayed price corresponds to the base rate per selected service. This base rate does not include the following items, which are charged as supplements at the prices indicated on the Platform:
- Fee per additional signatory beyond the main signatory
- Apostille fees (optional service)
- Postal delivery fees (optional service)
Prices may be modified at any time. The applicable rates are those in force at the time your order is confirmed.
8.2 Payment Methods
Payment is made online by:
- Credit or debit card (Visa, Mastercard, American Express)
- Any other payment method available on the Platform
Financial transactions are secured and processed by our payment provider Stripe. Payment is due upon confirmation of your order.
8.3 Invoicing
An invoice will be sent to you by email after each confirmed transaction.
8.4 Cancellations and Refunds
Before Service Engagement
As long as the identity verification session has not been initiated and your documents have not been submitted for processing, you may request a credit valid for 12 months by contacting our customer service at support@mynotary.io. No cash refund will be granted at this stage.
Non-Receipt of Access
In the event that you do not receive the email containing the link to your client area, we invite you to check your spam or junk mail folder before contacting our customer service.
If, after verification, the email was not received due to a proven and documented technical issue attributable exclusively to My Notary, and no identity verification session has been initiated, My Notary will offer the client the choice of:
- Immediate resending of the access link
- A credit valid for 12 months
No cash refund will be granted in this case, as the service remains available and accessible upon receipt of the link. Non-receipt of an email does not in itself constitute a failure to provide the service.
Service Engaged
Once the identity verification session has been initiated or your documents submitted for processing, the service is considered engaged and in progress. In accordance with applicable provisions regarding fully executed services, the right of withdrawal cannot be exercised. No credit may be issued for an engaged service.
Non-Compliant Documents
If your documents cannot be notarised due to non-compliance (illegible document, incomplete, not eligible for notarisation, unverifiable identity), a credit valid for 6 months may be issued following review of your file by our customer service, less processing fees incurred. No cash refund will be granted.
9. Service Interruption or Impossibility
9.1 Cases of Interruption
My Notary may be unable to provide the service in the following cases:
- Temporary unavailability of the Platform for scheduled or emergency maintenance
- Technical issue affecting the video conference (servers, hosting, third-party providers)
- Temporary unavailability of a notary
- Incident affecting our payment or identity verification providers
- Cyberattack or security incident requiring service suspension
- Force majeure as defined in these T&C
9.2 Consequences
In the event of an inability to provide the service for any of the reasons mentioned above, and if your payment has already been made, you will have the choice between:
- Priority access as soon as the service is restored
- A credit valid for 12 months usable across all our Services
- A full refund upon express request sent to support@mynotary.io
My Notary commits to informing you as soon as possible of any service interruption and the proposed solutions.
9.3 Exclusions
My Notary cannot be held responsible for service interruptions or impossibilities related to:
Client-Side Technical Issues
- Your internet connection or personal equipment
- Incompatibility of your browser or device with the Platform
- A handling error on your part
- Your absence or failure to respond during the verification session
- An environment unsuitable for video conferencing (noise, insufficient lighting)
Document-Related Issues
- Illegible, blurry or poor quality documents
- Incomplete or partially uploaded documents
- Documents in a format not accepted by the Platform
- Documents not eligible for notarisation
- Forged, fraudulent documents or documents showing signs of alteration
- Documents not matching the applicant's identity
- Documents written in a language that does not allow their processing
Identity Verification Issues
- Expired, illegible or damaged identity document
- Inability to verify your identity
- Refusal to submit to required verification steps
- Sovereign decision of the identity verification provider
In these cases, a credit valid for 6 months may be issued following review of your file by our customer service, less processing fees incurred. No cash refund will be granted.
10. Intellectual Property
10.1 Platform Content
All elements of the Platform (texts, graphics, logos, icons, images, software) are the exclusive property of My Notary or its partners and are protected by applicable intellectual property laws.
10.2 Licence of Use
You are granted a personal, non-exclusive and non-transferable right to use the Platform, solely for your own needs. Any unauthorised reproduction, representation, modification or exploitation is strictly prohibited.
11. Personal Data Protection
11.1 Collection and Processing
My Notary collects and processes your personal data in accordance with the UK GDPR, the Data Protection Act 2018 and applicable laws. Data collected includes:
- Identification information
- Contact details
- Identity documents
- Payment information
- Connection and browsing data
- Attribution data (traffic source)
11.2 Processing Purposes
Your data is used for:
- Provision of Services
- Account management
- Communication with you
- Service improvement
- Compliance with our legal obligations
- Fraud prevention and compliance with AML (Anti-Money Laundering) obligations
11.3 Retention Period
Your data is retained for the duration necessary for the purposes for which it is processed, in accordance with legal retention obligations. Notarised documents are archived in accordance with applicable legal requirements, for a minimum period of 7 years.
11.4 Your Rights
In accordance with the UK GDPR, you have the following rights:
- Right of access to your data
- Right of rectification
- Right to erasure
- Right to restriction of processing
- Right to data portability
- Right to object

11.5 Security
We implement appropriate technical and organisational measures to protect your data against unauthorised access, loss or destruction.
12. Confidentiality and Security
12.1 Document Confidentiality
Your documents are treated in strict confidence. They are only accessible to the notary assigned to your file and authorised My Notary personnel in the context of Service provision.
12.2 Session Security
Video conference notarisation sessions are secure and encrypted. A recording is made in accordance with legal requirements, exclusively for legal archiving purposes. This recording is retained in accordance with applicable legal obligations and is only accessible to authorised parties.
12.3 Secure Storage
Your documents are stored on secure servers with data encryption, hosted within the European Union.
13. Liability and Warranties
13.1 Best Efforts Obligation
My Notary commits to implementing all necessary means to provide a quality service, without guaranteeing any specific result regarding the acceptance of your documents by destination authorities.
13.2 Limitation of Liability
My Notary shall not be held liable for:
- Indirect, incidental or consequential damages
- Loss of profits, data or business opportunities
- Service interruptions related to force majeure
- Errors in documents provided by the Client
- Rejection of your documents by destination authorities
- Legal consequences related to the content of your documents
- Decisions made sovereignly by our identity verification provider
13.3 Client Warranties
You warrant that:
- You have the right and authority to have the submitted documents notarised
- Your documents are authentic and not fraudulent
- You use the Services for legal and legitimate purposes
- The information provided is accurate and truthful
14. Force Majeure
My Notary shall not be held liable for non-performance of its obligations in the event of force majeure, including but not limited to: natural disasters, network or equipment failures, wars, riots, civil unrest, government acts, strikes, epidemics or any other circumstance beyond My Notary's reasonable control.
15. Dispute Resolution
15.1 Complaints
For any complaint, contact our customer service at support@mynotary.io.
My Notary commits to acknowledging receipt of your request within 48 business hours and providing a full response within 14 business days.
My Notary reserves the right to terminate any communication with a client displaying abusive, offensive, threatening or harassing behaviour towards its staff or partner notaries. In such cases, My Notary may, without prior notice and without this giving rise to any right to a refund:
- Temporarily or permanently suspend communications with the client concerned
- Close the file in progress if the behaviour prevents proper handling of the complaint
- Suspend or terminate the client's account
This decision will be notified to the client by email to the address associated with their account.
15.2 Mediation
In the event of a dispute, you may resort to mediation before taking any legal action. My Notary subscribes to the consumer mediation service [to be completed].
15.3 Governing Law and Jurisdiction
These T&C are governed by the laws of England and Wales. In the event of a dispute, and failing amicable resolution, the competent courts of England and Wales shall have sole jurisdiction, without prejudice to mandatory consumer protection rules applicable in your country of residence.
16. Modification of T&C
My Notary reserves the right to modify these T&C at any time. Modifications will take effect upon publication on the Platform. You will be informed of significant modifications by email. Your continued use of the Platform after modification constitutes acceptance of the new T&C.
17. General Provisions
17.1 Entire Agreement
These T&C constitute the entire agreement between you and My Notary regarding the use of the Platform.
17.2 Severability
If any provision of these T&C is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
17.3 Waiver
My Notary's failure to exercise any right provided under these T&C shall not constitute a waiver of that right.
17.4 Assignment
You may not assign your rights or obligations under these T&C without our prior written consent.
